Claim filed regarding council decision to deny Development Variance Permit

The City of Grand Forks says they’ve been notified of a petition to the Supreme Court of BC.

This as a claim was filed regarding a Grand Forks city council decision dating back to the July 15th regular meeting. It was at that meeting that council considered a Development Variance Permit to reduce a 100 meter setback to 36 meters at 7500 Donaldson Drive. The Variance would have been between a Community Use Zone and proposed non-medical cannabis retail store, but was denied.

The 492 page document seeks that the decision be set aside, and the decision to accept the report be set aside. It also seeks declaration that the City’s application procedures are contrary to that of the Local Government Act, declaration that the decision was incorrect and/or unreasonable, and more.

None of these allegations have been tried in court. The City says they cannot make further comment.
